Welcome to Moko Makes. These terms govern your use of mokomakes.com
and any purchase you make from us. By using this site or placing an
order, you agree to them. Please read them before you buy.

1. Who can order

You must be at least 18 years old, or have the permission of a parent
or guardian, to place an order.

2. Our products are handmade

Every piece is made by hand. Beads, glass, and natural stones vary in
color, size, and finish from batch to batch, and no two pieces are
identical. Product photographs represent a characteristic example
rather than the exact item you will receive. Slight variation in bead
placement, color depth, and drop length is a feature of handmade work,
not a defect.

Screen calibration also affects how color appears. If exact color
matching matters for your purchase, email us before ordering and we
will describe the piece in detail or send an additional photo.

3. Materials and sensitivities

We work with a range of materials, and every product page lists
exactly what that piece is made of. Where a piece uses 14k gold filled
or surgical grade stainless steel findings, that is noted in its
materials list.

Individual sensitivities vary and we cannot guarantee that any
material will be suitable for every person. If you have known metal
allergies, please review the materials list for the specific piece and
consult your physician before wearing.

Our jewelry contains small beads and components and is not intended
for children under 13. Keep away from small children and pets.

Jewelry is decorative and is not intended to diagnose, treat, or
provide any therapeutic or healing effect.

4. Pricing and product information

All prices are in U.S. dollars and do not include tax or shipping,
which are calculated at checkout. We reserve the right to change
prices, modify products, or discontinue items at any time without
notice.

We work to keep product descriptions and pricing accurate, but errors
occur. If an item is listed at an incorrect price or with an incorrect
description, we may cancel the order and issue a full refund, whether
or not the order has been confirmed.

5. Orders

Your order is an offer to purchase. We accept it when we send your
shipping confirmation. We may refuse or cancel any order at our
discretion, including where we suspect fraud, where an item is
unavailable, or where a pricing error has occurred. If we cancel a
paid order, we refund it in full.

Because some pieces are made after you order, we can only change or
cancel those orders before work begins. Email us as soon as possible
and we will accommodate the request if we can.

6. Payment

We accept the payment methods shown at checkout. You confirm that you
are authorized to use the payment method you provide. Payment is
processed by our payment providers. We do not store your full card
details.

7. Shipping and risk of loss

Shipping timelines and costs are described on our Shipping Policy
page. Production time is separate from transit time, and both are
stated at checkout.

Title and risk of loss pass to you when the carrier accepts the
package. We are not responsible for carrier delays. If a package is
lost or damaged in transit, contact us. See our Returns and Refunds
policy, and we will work with you to resolve it.

You are responsible for providing a correct and complete shipping
address. Packages returned to us due to an incorrect address may be
reshipped at your cost.

8. Returns

Our Returns and Refunds policy is part of these terms. Please review
it before ordering.

9. Custom and made to order pieces

Custom commissions are quoted individually and confirmed in writing
before work begins. Custom pieces are final sale and nonrefundable, as
they cannot be resold. Deposits on custom work are nonrefundable once
materials have been purchased.

10. Our intellectual property

The Moko Makes name, logo, product names, designs, photographs,
written content, and site design are our property and are protected by
copyright and trademark law. You may not reproduce, distribute, or
create derivative works from them without our written permission.

Purchasing a piece grants you ownership of that physical item. It does
not transfer any rights in the design. Reproducing our designs for
commercial sale is prohibited.

11. Content you submit

If you post a review, photo, comment, or other content on our site, or
tag us on social media, you grant us a nonexclusive, royalty free
license to use, display, and reproduce that content in connection with
our business, including in marketing, with attribution to your handle
where practical. You confirm the content is yours to share and does
not infringe anyone else's rights.

We may remove any content at our discretion.

12. Acceptable use

You agree not to use this site to violate any law, infringe anyone's
rights, transmit malicious code, scrape or harvest data by automated
means, interfere with the site's operation, or attempt to gain
unauthorized access to any part of it.

13. Third party links

Our site may link to third party sites and services. We do not control
them and are not responsible for their content, policies, or
practices.

14. Disclaimer of warranties

Except where prohibited by law, our products and this site are
provided "as is" and "as available," without warranties of any kind,
express or implied, including implied warranties of merchantability,
fitness for a particular purpose, and noninfringement.

We do not warrant that the site will be uninterrupted, error free, or
free of harmful components.

15. Limitation of liability

To the fullest extent permitted by law, Moko Makes and its owners
shall not be liable for any indirect, incidental, special,
consequential, or punitive damages arising from your use of this site
or our products.

Our total liability for any claim relating to a product or order shall
not exceed the amount you paid for that order.

Some jurisdictions do not allow certain limitations, so parts of this
section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Moko Makes and its owners
from any claim or demand, including reasonable attorneys' fees,
arising from your breach of these terms or your violation of any law
or third party right.

17. Governing law

These terms are governed by the laws of the State of Indiana, without
regard to conflict of law principles. Any dispute shall be brought in
the state or federal courts located in Hamilton County, Indiana, and
you consent to their jurisdiction.

18. Severability

If any provision of these terms is found unenforceable, the remaining
provisions remain in full effect.

19. Changes to these terms

We may update these terms at any time. The version in effect at the
time of your order governs that order. Continued use of the site after
changes are posted constitutes acceptance.
